I think that is a fair point. There had to be some people there who were not malicious in the least. They were collateral damage of the legal system. I remember a case in Waco, Texas where there was a shootout at a restaurant among rival biker gangs. The local elected DA, a Republican, just went through and charged every single person there with conspiracy to commit capital murder because he didn't have a clue what the facts were. Many of these innocent people are still in jails and prisons today many years after the fact. This due in part to the fact that they could not afford legal representation. A miscarriage of justice? Absolutely. But it happens and political parties either way are no respecter of the law and order that the framers expected. I get your point, but I think it speaks to a bigger problem.
